No really, he did. Perez Hilton is getting sued (again) by Lindsay Lohan’s former bff, DJ Samantha Ronson. Sam is pissed that Perez claimed she was the one who planted coke in Lindsay’s car during her unfortunate curb and tree homicide on May 26.
Samantha Ronson has sued Perez Hilton for defamation after he repeated a report that first appeared on the Web site CelebrityBabylon.com.
“I am not now and have never been a drug user,” Ronson stated in a supplemental declaration filed with the court on Monday. “I have never handled or touched cocaine. I did not ever place any cocaine at any place at any time.”
According to the lawsuit, both postings defamed Ronson by stating she planted drugs that were found in Lohan’s car after it crashed into a tree in Beverly Hills on May 26, and that she set up her friend to be photographed while under the influence of alcohol.
Captain Shiteous’ lawyer had this to say:
“If Ms. Ronson is attempting to get some sort of relief in court and to show that Mario Lavandeira had any malice, I think she’s going to a hardware store for milk. It’s just not going to happen,” Freedman said.
He was always one for a metaphor. I can see why Perez keeps his ass on retainer. He should write for this column. How come no one ever sues me? When I (erroneously) repeated reports that New York’s mother was an actress, I got raked over some damn coals but no legal action. Why? Because lawyers don’t want to be linked with “I Love New York”. Perez is a douche. When they were promoting his show on VH1 (I think it was Perez’s thoughts on the MTV awards or something??) Anyways, my husband watches the commercial, turns to me and says ‘who the hell is this choad??’ I laughed my ass off.

Perez truly is foul. He’s like when someone rips one in an elevator and you can’t get out, so you stand there holding your breath with your heart pounding in agony. And when you finally do get out, you can still smell it on your clothes and you just want to get home as quickly as possible to take a damn shower.
Foul and disgusting. Why people strive to be hated rather than adored, I’ll never understand. I don’t think I’ll ever get over the pics of him in the pink wig, standing on the corner with his man panties. I should sue him for emotional distress.

While I hope that Perez gets his comeuppance (since I really just hate his snarkiness and general mean-spirited discourse), it sounds like Ronson will lose. The attorney’s arguing that there is a requirement of malice, which means they are probably going to say that it is a case of public concern involving public figures. Since Ronson is somewhat of a public figure, in that she has achieved some fame or notoriety and has voluntarily assumed a central role in a particular public controversy, she is going to have to prove that Perez had knowledge that the statement was false or that he had reckless disregard for it’s falsity. General spite or ill will doesn’t cut it. It’s such a difficult standard to meet, which is why more public figures don’t sue for defamation…
Oh, and J. Harvey, you don’t get sued for defamation cuz you haven’t made any defamatory statements which damage a person’s reputation. And it’s a good thing too since such lawsuits would cost TONS!
