Kevin Costner’s estranged wife admits she may not have understood their prenup, asks for a definition of ‘understood’

Kevin Costner’s lawyers have taken a new aim at his estranged wife, Christine Baumgartner, over claims she “didn’t understand” their pre-nuptial agreement.

Since Costner and Baumgartner announced they were splitting in May this year, the pair have been locked in contention from everything from their assets being divided to the amount of child support he should pay.

But in new legal documents obtained by TMZ, Costner’s lawyers have contested the fact, Baumgartner, according to her team, didn’t understand the prenup.

According to the site, Baumgartner’s legal team has asked for a definition of “understand” as part of their case.

Kevin Costner’s lawyer, led by Laura Wasser, has stated: “Christine asserts she cannot admit or deny that she understood the Premarital Agreement because she (and apparently all of her attorneys) do not understand the word ‘understand’.”

“Christine's counsel asked for a definition of ‘understood' and Kevin's counsel provided the dictionary meaning of the word ‘understood,' to wit, ‘comprehend or perceive the intended meaning of words’,” they added.

From this, the team is requesting Baumgartner’s team confirm the former handbag designer understood the terms of the prenuptial agreement.

The bizarre request stems from the fight against the prenup, which Baumgartner is now contesting elements of.

Wasser argues that Baumgartner was aware of the legal weight of the pre-nuptial agreement before she signed it.

Her lawyers objected to the question and refused to answer, as the “request was vague as to the scope and meaning of the terms ‘understood.'”

A hearing regarding the argument over the prenup is now scheduled for November.

If the judge weighs in Costner’s favor, Baumgartner will be liable for all the Yellowstone actor’s legal fees and must return the $ 1.5 million he gave her as a lump sum when they first announced their divorce.

This initial payout was in line with the prenup, but it came with an addendum that she could only receive it if she didn’t fight the document’s conditions.

Since then, Baumgartner has contested the amount of child support he should be paid by Costner and her living situation.

As part of the agreement, Costner kept possession of their homes, but Baumgartner refused to leave the California compound she lived in with her children within the 30 days she was granted.

When the courts ruled in Costner’s favor, there was a further issue over who could take what from the property, with both sides offering different accounts on what Costner and Baumgartner were requesting.

She now lives in a $ 35,000-a-month rental in Santa Barbara, California, with four bedrooms and four bathrooms to facilitate their three children, Cayden, 16, Hayes, 14, and Grace, 13.
