Halle Berry is pushing for full custody of her son with former partner Olivier Martinez.
TMZ reports that Berry wants this change because of “Martinez's ongoing breaches of Court Orders, solo decision-making, and actions against the best interests of their child.”
Berry admits she's “not perfect,” but says she “always tries to put the best interests” of their 10-year-old son Maceo first.
The documents claim Martinez's “disruptive and harmful behavior” towards educational and therapy efforts for their son has strained his relationship with Berry.
Berry alleges Martinez has blocked educational and mental health evaluations for Maceo, including tutoring when he fell behind in school. She claims he's used soccer as a bargaining chip in custody talks, dismissed therapy for Maceo and co-parenting sessions, and failed to stick to agreed custody schedules.
“[Martinez's] actions and lack of cooperation with respect to Maceo's psychological and educational needs have been detrimental to Maceo's health and welfare,” the papers state. “Respondent's refusal to allow early interventions have caused Maceo to fall further behind in school, caused Maceo's acting out behaviors to worsen, and caused further damage to Maceo's and Petitioner's relationship.”
The documents also claim Martinez has been talking about the custody fight in front of their son, which their original divorce deal banned.
“Maceo wasn't shielded from [Martinez's] behavior, which got worse as [he] refused therapy for Maceo. Maceo acted out when he returned” from his dad's, allegedly becoming “angry and confrontational” with Berry, which worsened with longer stays in his father's care, Berry claimed.
“[Martinez's] actions and lack of cooperation with respect to Maceo's psychological and educational needs have been detrimental to Maceo's health and welfare.”
“Before therapy, Maceo would often repeat arguments the parents had in private – which Petitioner [Berry] didn't discuss with Maceo – often siding with Respondent or telling Petitioner how he and Respondent would handle the issue, completely ignoring Petitioner's input or authority as a parent,” the papers state.
Representatives for Berry and Martinez didn't immediately respond when Fox News Digital asked for comment.
The ex-couple finalized their divorce last year after an eight-year legal battle. At the time, Berry was paying nearly $8,000 monthly in child support for Maceo. She also had to pay Martinez 4.3% of any income over $2 million to cover Maceo's private school fees and all his extracurricular activities.
The divorce agreement requires Martinez to take “reasonable action” to find work and contribute to Maceo's care.
It also bans Berry and Martinez from speaking badly about each other in front of Maceo.
Berry's new filing stresses this point, stating that “the parties be specifically enjoined and restrained from discussing their respective positions on child custody issues or the contents of these proceedings with Maceo.”
